Terms of use

Last updated October 22, 2026

These terms apply to your use of accessclerk.com and the AccessClerk scanner (the "Service"). By using the Service you agree to them. If you use it on behalf of an organization, you agree on that organization's behalf.

What the Service is

AccessClerk runs automated accessibility checks on web pages you submit and lists documents linked from those pages. Results are generated by software, including the open-source axe-core engine, and may include plain-English explanations and suggested fixes.

What the Service is not

  • Not a compliance guarantee. Automated tools detect only a portion of accessibility problems. A report with few or no findings does not mean a page is accessible, and no result from the Service certifies or guarantees compliance with the Americans with Disabilities Act, Section 504 or 508 of the Rehabilitation Act, the Web Content Accessibility Guidelines (WCAG), or any other law, regulation or standard.
  • Not legal advice. AccessClerk is not a law firm. Nothing in the Service, including information about deadlines or legal requirements, is legal advice or creates an attorney-client relationship. Consult a qualified attorney about your obligations.
  • Not protection from claims. Using the Service does not prevent, defend against or resolve any complaint, demand letter, lawsuit or government enforcement action.
  • Not a substitute for human testing. Suggested fixes, including any generated by AI, can be incomplete or wrong. Review every change before you make it, and test with real assistive technology.

Your responsibilities

  • Only submit publicly available pages, or pages you are authorized to test.
  • Do not use the Service to overload, attack or gain unauthorized access to any website or system, or to get around our usage limits.
  • Do not resell or present our results as a certification of compliance.

Paid plans

If you buy a paid plan, the price, billing period and refund terms will be shown before you pay and form part of these terms.

No warranty

The Service is provided "as is" and "as available," without warranties of any kind, express or implied, including warranties of accuracy, completeness, merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the Service will be uninterrupted or error-free.

Limitation of liability

To the fullest extent permitted by law, AccessClerk and its owners will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, revenue, data or goodwill, or for any legal fees, settlements, judgments or penalties, arising from your use of or reliance on the Service. Our total liability for any claim relating to the Service is limited to the amount you paid us for the Service in the 12 months before the claim, or $100 if you have paid nothing.

Changes

We may update the Service and these terms. If we make material changes we will update the date at the top of this page. Continuing to use the Service after a change means you accept the updated terms.

Governing law

These terms are governed by the laws of the State of Texas, without regard to its conflict-of-law rules.
